Domestic violence victims as perpetrators
In our society, violence is not tolerated with a few exceptions. These usually involve the protection of life. In such instances, not only is violence accepted but can be cause for adoration. The defender is oftentimes considered a hero. However, a survivor of domestic violence who engages in self-defense against an abuser is never a hero. This stems directly from the public’s tainted view of victims of domestic violence. The general public places all responsibility on the survivor because they “should have left.” As a result, survivors are erroneously categorized as willing participants to any physical confrontation. It can be hard for the public to agree with an arrest of a victim; yet, the arrest of a willing participant is justified. This then leads to the incarceration of survivors. Why do we allow the lack of mercy and compassion in criminal investigations of survivors who used self-defense against an abuser?
If you were the victim of domestic abuse, whether or not it was ever reported, it is important for the Court to know this as part of mitigation before sentencing. Many times, a mitigation specialist can aid in issuing a report after speaking to family and friends and helping obtain medical records. Feel free to contact our office if you have any questions or need our assistance preparing for a sentencing.
